Convention 

  • Thank you to all who helped and participated in this year's PFFNH 12th Biennial Convention. We accomplished a lot and heard from several speakers to discuss their upcoming November 2012 elections. We all here in the office appreciate everyone's dedication and commitment to completing all necessary business for this year's convention. 
  • Regarding our legislative resolutions, we did pass 3 resolutions to endorse Annie McLane Kuster for CD2, Carol Shea Porter for CD1 and Chris Pappas for Executive Council District 4. 

LGC

  •  LCG bill, SB 212 finally wrapped up in the House ways and means committee, it now goes to the full house floor for a vote. It will likely go through, but it is vastly different than the Senatebill so a Committee of Conference is most likely the next step. The bill was improved upon from the Senate version, as it now defines reserve and surplus in a way that insures that risk pools cannot hang on to millions of extra money, and it has to be returned to the cities and towns.
  • LGC hearings happening with the Secretary of State and the BSR are wrapping up this week.
  • LGC supreme Court decision in our RTK request for unredacted minutes was released today:
    • The Supreme Court affirmed the previous decisions in Merrimack County Court by Judge McNamara.
    • This decision is NOT a loss for our union, regardless of what the LGC says.
    • In the decision, the court declared that because no member of the public was present during these meetings, the information was protected by attorney client privilege. However, had one member of the public entered that room, we would have seen a different outcome.
    • This case was affirmed on a mere technicality, by the absence of one public member at one of these meetings.
    • We believe the decision has been written in such a way as to only deal with this set of minutes from the LGC, and our attorney believes it will not set a precedents moving forward.

Retirement

  • House Special Pension committee voted on SB229 – which they amended on Thursday, and several other retirement bills came out of committee. 
  • The amendment, introduced to SB229(Senate version of DC study commission) by Representative Cohn includes a new study committee
    • This study committee will include 4 Representatives and 2 Senators which will make up the voting members of the committee
    • A non-voting advisory committee will include several members including chair of NHRS board of trustees, 1 member of Group I and 1 member of Group II, plus several public members that have experience in financial investing and retirement plan design and administration.
    • This committee will need to report by November 1, 2012. 
    • If passed, this committee will have the legal right to request RFPs from public entities and charge them $10,000 to respond to the RFP. 
    • If the report the committee submits as legislation is NOT agreed to by the House, Senate and Governor inclusively, the original version of SB229 (the DC – 414(h)) plan introduced by Senator Groen will become law November 1, 2013 for all new state employees, but it gives cities and towns the option of joining if they so choose. 
  • The House Finance committee also passed SB230 and SB244, which are technical changes bill that Rep Kurk had said he may amend to make changes to the Maximum Benefit allowance – making it only 50% of base pay. This did not happen, so unless he does it on the House floor, these bills should pass without much controversy.
  • The House has a different opinion regarding SB228 – the repeal of the spiking provision. Rep Kurk has created a new equation and calculator for Spiking that at this point is to take place in 2013. He will be introducing a floor amendment to make the implementation date July 2012. 
  • All bills will come to the floor next week – Tues Weds, or possibly Thursday. 

 

House and Senate this Week

  • We are now done with committee meetings in the House and Senate. The House meets twice this week(Tues and Weds and possible Thurs) and the Senate meets once (Weds). This should wrap up all bills, EXCEPT the ones going to committee of conference and tabled bills, which are quite a few.
  • Up next week is HB 1206, the health care increase at impasse bill. It was special ordered to this week, from last Wednesday. We, in conjunction with the AFL, are working very hard to kill this bill in the Senate.
  • We will also here SB212 and all Retirement related bills. 

 

CDL Licenses

  • A few weeks back we discussed renewing or applying for CDL licenses. Please find attached a document that explains the differences and which box to choose if you are getting your CDL license to drive fire trucks only.
